Terms of Service
The Futurist NYC LLC DBA The Future NYC ("we", "our", or "us") reserves the right to make updates to these Terms of Services and all documents included.

We may change, add or remove portions of these Terms of Service at any time by posting a new version without notice to you.
By agreeing to be bound by the terms of service, you agree that all disputes between The Futurist NYC LLC and You will be resolved by binding arbitration. Your agreement to arbitration states that disputes will be decided by an arbitrator, and you agree that all disputes will be brought only on an individual basis, and you are waiving your right to bring or participate in a class action or class arbitration. By using any and all The Futurist NYC LLC's services, products, subscriptions, ("Services") including but not excluding our www.TheFuture.NYC website, ("Site") you are agreeing to abide to all terms and conditions.
If any terms are unacceptable, you can discontinue your visit to the Site, discontinue the use of services, and cancel your subscription. Your continued use of service indicates acceptance of service, changes or modifications.
MEDIA CONTENT SERVICES
The contents of services included on the Site, are intended for personal, non-commercial use and all materials published or available (including but not limited to text, design, video, compilations, content) otherwise defined as "Media & Content" is owned or controlled by The Futurist NYC LLC.
The Futurist NYC LLC also owns the copyright in the compilation, selection, coordination, arrangement and enhancement of such Media & Content.
The Futurist NYC LLC does not authorize the use of its Media & Content without prior written consent in connection with:
(A) The development of any software or hardware program, including but not excluding any generative AI or quantum tool, model, algorithm, sequence or frequency to train or use the Media & Content in connection with the development or operation of any artificial intelligence (AI) systems, quantum systems, quantum AI systems or neurotechnology systems. This includes any use of the Media & Content in training, fine tuning, creating or advancing systems as part of augmented learning, articulation, tutoring, retrieval, production or enhancement, or (B) providing archived, cached, live-streamed or brainwave datasets containing Media & Content to another person or entity. Note: *articulation: a systematic method of constructing correct, or moral, idea masses in the student's mind.
The Futurist NYC LLC's services and content are protected by sui generis rights, including sui generis database rights. You may not scrape our Media & Content in any way shape or form—by man, bot or agentic swarms or otherwise—or try to hack our system without permission.
To the maximum extent permitted by applicable laws, the services are distributed on an "as is" basis without warranties of any kind, either expressed or implied, and services could be interrupted and contain errors, omissions, inaccuracies or delay in the Media & Content made available through our services.
The use of our Media & Content is at your sole risk. Our Media & Content provides forward looking statements.
Release and Waiver: To the maximum extent permitted by applicable law, you hereby release and waive all claims against The Futurist NYC LLC, The Future NYC, and its subsidiaries, affiliates, officers, agents, licensors, co-branders or other partners, and employees from any and all liability for claims, damages (actual and/or consequential), costs and expenses (including litigation costs and attorneys' fees) of every kind and nature, arising from or in any way related to your use of The Future NYC website, The Futurist NYC LLC products, subscriptions or services. If you are a California resident, you waive your rights under California Civil Code 1542. You understand that any fact relating to any matter covered by this release may be found to be other than now believed to be true and you accept and assume the risk of such possible difference in fact. In addition, you expressly waive and relinquish any and all rights and benefits which you may have under any other state or federal statue or common law principle of similar effect, to the fullest extent permitted by law.
Hold Harmless and Indemnity. To the maximum extent permitted by applicable law, you agree to hold harmless and indemnify The Futurist NYC LLC, The Future NYC and its shareholders, directors, officers, employees, advertisers, content providers, subsidiaries, affiliates, officers, agents, licensors, co-branders and other partners, from and against any claim from you or any other person arising from or in any way related to your use and interaction with The Futurist NYC LLC and The Future NYC, including any liability or expense arising from all claims, losses, damages (actual and/or consequential), suits, judgements, litigation costs and attorneys' fees, of every kind and nature.
General Terms: Notwithstanding any provision hereof, for all purposes of the Terms of Use, you and The Futurist NYC LLC shall be and act independently and not as partner, joint venturer, agent, employee or employer of the other. You shall have no authority to assume or create any obligation for or on behalf of The Futurist NYC LLC or The Future NYC, express or implied, and you shall not attempt to bind The Futurist NYC LLC or The Future NYC to any contract.
No Waiver of Rights by The Futurist NYC LLC. Our failure to exercise or enforce any right or provision of the Terms of Use shall not constitute a wavier or such right or provision.
Fees and Payments
We reserve the right to charge fees for access to our Services or portions of our Services at any time, and you shall not be charged for access unless you have agreed to pay such charges. You may cancel at any time, and please see our Terms of Sale agreement. All fees and applicable taxes must be paid relating to your use of Services.
Third Party Content and Links to Websites
When you access content that is linkable from our site, you accept the risks, and The Futurist NYC LLC, The Future NYC is not responsible. The Futurist NYC LLC, The Future NYC does not endorse, sponsor or recommend any linked content to any outside sources. We do not monitor, verify, censor or edit any content of any linked content site or service. By using our service, you release and hold The Futurist NYC LLC, The Future NYC and all its partners, affiliates, employees, shareholders, advertisers, agents and other persons, entities and partners, harmless from any and all liability arising from your use of any linked content service or website.
Any headings contained in this agreement are included for convenience only and shall not limit or otherwise affect the terms of The Terms of Use. Any construction or interpretation to be made of the Terms of Use shall not be construed against the drafter.
